The Human Rights Act 1998 imposes a positive obligation on public authorities to act in a way that is compatible with the rights contained in the Convention; it is unlawful for public authorities to act incompatibly with the Convention. Public Authorities must bear in mind the Act and its provisions when carrying out all of its duties, functions and activities. This includes when dealing with and responding to incidents of Discrimination, Harassment, Bullying or Victimisation.
Somerset County Council will at all times recognise and respond to its legal duties and obligations under this Act.
Somerset County Council will pay particular regard to Article 14 of the Convention when responding to discriminatory incidents which states:
"The enjoyment of the rights and freedoms set forth in this convention shall be secured without discrimination on any ground, such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status."
Any employee who experiences bullying, harassment or discrimination may bring a claim under the Act. Examples of possible claims that could be made under the Act are where any form of punishment can be described as inhuman or degrading or disproportionate or where there has been a breech of the rules of natural justice and fair procedures when complaints of bullying harassment and discrimination are being investigated.
Somerset County Council will also adhere to the duties, obligations and requirements of the below Acts when responding to incidents of Harassment, Discrimination, Bullying and Victimisation:
