Overview
You will be sent a final copy of the Education, Health and Care plan when it’s issued. Your child’s educational setting will also get a copy. This must take no more than 20 weeks after we received your initial request for assessment. This is the end of stage 3 of the education health and care process.
The plan will remain in place until your child leaves formal education, or we agree that it is no longer needed because they have made good progress.
The plan will be reviewed every year, or more often if necessary.
Implementing support
We will have told the educational setting that your child has an Education, Health and Care plan and they would be expected to review it thoroughly so that they fully understand your child’s needs and the specific support required. They are now responsible for arranging and delivering the provision (unless direct payments or EOTAS has been agreed). They may be doing quite a lot of the support already, so you may not see much change day-to-day.
The setting will make sure that the staff members that teach your child know about their special educational needs.
The setting is responsible for arranging and managing the annual review, find out more in the next section.
If you have any concerns about what support is being provided, see our Provision within the Education, Health and Care plan page.
Appealing the Education, Health and Care plan content
We work hard to include young people’s and parent carer’s ideas and views in a plan and give opportunities for changes to be made. If you still disagree with what is in a final Education, Health and Care plan it is best to talk to the Special educational needs and disabilities Assessment and Review Team who will help you understand why they made their decisions. If you still can’t come to an agreement you can ask for disagreement resolution or mediation.
If you decide to appeal what’s in the final Education, Health and Care plan your child should still be supported at school or college.
